These Terms of Service (“Terms”) govern your use of Testimonial Collector (“we,” “us,” or “our”), operated at testimonialcollector.net. By accessing or using the service, you agree to be bound by these Terms. If you do not agree, you may not use the service.

1. Description of Service

Testimonial Collector provides tools to collect, manage, and display customer testimonials on your website. We offer a free tier and a paid Pro plan with additional features.

2. Account Responsibilities

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Upload fabricated, misleading, or fraudulent testimonials
• Use the service to harass, defame, or infringe the rights of others
• Attempt to gain unauthorized access to the service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the service
• Transmit malware, viruses, or other harmful code
• Violate any applicable local, state, national, or international law

4. Payment Terms

• The Pro plan is billed monthly at the price displayed at checkout. All payments are processed by Stripe.
• You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months. Upon cancellation, you retain access to Pro features until the end of your paid billing period.
• We reserve the right to change pricing with 30 days’ notice. Price changes will not affect your current billing cycle.

5. Intellectual Property

The service, including its design, code, logos, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the service.

6. User Content

You retain ownership of the testimonials and content you submit to the service. By using the service, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the service. You are responsible for ensuring you have the right to collect and display testimonials from your customers.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The service is provided on an “as available” basis. We may perform maintenance, updates, or experience outages that temporarily affect access. We are not liable for any downtime or data loss resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Testimonial Collector and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Testimonial Collector and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activity that harms the service or other users. You may delete your account at any time. Upon termination, your right to use the service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the service after changes constitutes acceptance of the updated Terms.
